Custom Diamond Experience Contest

Entry Period: The Contest ("Contest") will begin on April 11, 2025 at 8am eastern time and end on April 30, 2025 at 11:59pm eastern time ("Entry Period").  

Sponsor: The Contest is sponsored and administered by Members 1st Federal Credit Union (“Sponsor”). 

Agreement to Official Rules: Participation in the Contest constitutes entrant’s ("Entrant's") full and unconditional agreement to these Official Rules, and Sponsor's decisions, which are final and binding in all matters related to the Contest. Winning is contingent upon fulfilling all requirements set forth herein. 

Eligibility: The Contest is open and offered only to Entrants 18 years or older as of the start of the Entry Period, who reside in Pennsylvania. Employees, officers and directors of Sponsor and their parents, affiliates, subsidiaries, divisions, advertising, promotional, fulfillment and marketing agencies, their immediate families (including parents, children - whether step children or adoptive children or biological children - siblings, spouses and in-laws), and persons living in the same household (whether related or not) are not eligible to participate in the Contest. Void where prohibited or restricted by law, rule or regulation. Only one entry per person.  

How to Enter: Enter the Contest by preparing and submitting your custom jewelry design with a brief description of the meaning or inspiration for your custom jewelry design in 250 words or less (“Your Submission”) at the following link https://www.members1st.org/75/custom-diamond-experience-contest/. Please note that the brief description is not included in the criteria for winning this Contest. 

By entering the Contest and submitting an entry, you grant Sponsor a royalty-free, non-exclusive irrevocable license to publish Your Submission in any and all mediums throughout the world and the universe.  To be eligible, Your Submission must be your original work and must not infringe or violate the rights of others.  By entering the Contest and submitting Your Submission, you represent and warrant that Your Submission is your original work and that you created the design submitted.  By submitting Your Submission, you further represent and warrant that Your Submission does not violate or infringe on another person’s rights, including, but not limited to, privacy, publicity, copyright, trademark or other intellectual property right.  Entries that, in Sponsor’s sole judgment, contain objectionable or inappropriate content are ineligible.  Sponsor shall determine the eligibility of Your Submission in their sole and absolute discretion. By entering the Contest and submitting an entry, you grant Sponsor a royalty-free, non-exclusive irrevocable license to publish Your Submission and your name, image, voice, likeness and any photographs or video of you in connection with this Contest (the “Promotional Materials”) on Facebook, X, Instagram or LinkedIn and to allow third parties to share the Promotional Materials on Facebook, X, Instagram or LinkedIn. Sponsor may use the Promotional Materials in connection with internal and external communications materials including, but not limited to websites, advertising, and other promotions.  

If you choose to include people in Your Submission in the nature of a photograph submitted in connection with Your Submission, you warrant and represent that each person pictured has given you written permission to be included in Your Submission and for Sponsor to publish their likeness.  You represent and warrant that none of the persons depicted in Your Submission are under the age of 18, or if they are under the age of 18 that you are the legal parent or guardian of the child under the age of 18.  You agree to provide a copy of this written release upon request.

All entries must be received by April 30, 2025 at 11:59pm eastern time. Incomplete entries, or those containing incorrect information, will be void. Proof of sending or submission will not be deemed to be proof of receipt by Sponsor. Use of any automated system to submit entries is prohibited and will result in disqualification of all such entries as well as the Entrant. All entries become the property of Sponsor and may not be acknowledged or returned. 

Prizes & JUDGING: One winner will be selected by a team of judges consisting of the Sponsor’s employees, and the winner will win a prize consisting of the opportunity to design a custom piece of jewelry worth up to $5,000 in collaboration with Leitzel’s Jewelry. Your Submission will be judged based on its creativity and sentimentality.  All judging is final.  Leitzel’s Jewelry will assist winner in designing the custom piece of jewelry within the amount indicated above. If the custom piece of jewelry is to exceed $5,000 at the insistence of the winner, the winner is responsible for covering the difference in cost.  If the custom piece of jewelry costs less than $5,000, the winner will not receive the difference.  No substitution or transfer of prizes will be permitted. The Sponsor reserves the right at its sole discretion to substitute a prize with another prize of equal or greater value in the event that the aforementioned prize is not available.  

Notification of Winners: Each winner will be notified by Sponsor at the email address provided in the entry by May 14, 2025. Winners must respond within forty-eight (48) hours to confirm receipt of notification of winning, sign any affidavit of eligibility, release of liability, tax documents and appearance release that may be required by Sponsor in connection with the awarding of the prize and accept prize or an alternate winner will be chosen.

In the event of noncompliance with the Official Rules, if a potential winner cannot be reached through the contact information provided with winner's entry or if the prize or prize notification is returned as unclaimed or undeliverable, an alternate winner will be selected. 

LIMITATIONS OF LIABILITY: Employees, officers and directors of Sponsor, Judges and their respective parents, affiliates, subsidiaries, divisions, advertising, promotional, fulfillment and marketing agencies (collectively the "Released Parties") shall not be responsible for: (1) any incorrect or inaccurate information, whether caused by any Entrant, printing errors or by any of the equipment or programming associated with or utilized in the Contest; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Contest; (4) technical or human error which may occur in the administration of the Contest or the processing of entries; (5) late, lost, undeliverable, damaged or stolen mail; or (6) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from Entrant’s participation in the Contest or receipt or use or misuse of any prize.  Sponsor is not responsible for misdirected or undeliverable entries or for any technical problems, malfunctions of computer systems, servers, service providers, hardware/software, lost or unavailable network connections or failed, incomplete, garbled or delayed computer transmission or any combination thereof.  Sponsor is not responsible for any typographical or other errors in entries, selection announcement or for any liability for damage to any computer system resulting from participation in, accessing or downloading information in connection with this promotion.  In the event Sponsor is prevented from awarding prizes or continuing with the Contest as contemplated herein by any event beyond its control, including but not limited to fire, flood, natural or man-made epidemic of health or other means, earthquake, explosion, labor dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, terrorist threat or activity, war (declared or undeclared) or any federal, state or local government law, order or regulation, public health crisis, order of any court or jurisdiction, or other cause not reasonably within Sponsor’s control (each a “Force Majeure” event or occurrence), then Sponsor shall have the right to modify, suspend or terminate the Contest.  Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. 

Other Terms & Conditions: CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON(S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW. The Contest is subject to all applicable federal, state, and local laws. In the event of a dispute regarding the identity of an individual who submitted an entry, the entry will be deemed submitted by the authorized account holder of the phone number or email account associated with the entry or through which the entry was submitted.  "Authorized account holder" shall be defined as the natural person who is assigned to an email account or phone number by the respective service provider.  Selected winner may be required to show proof of being the authorized account holder.  Sponsor reserves the right, in its sole discretion, to disqualify any entry and to modify, terminate or suspend this Contest should virus, bugs, non-authorized human intervention, action of entrants, or other causes beyond the reasonable control of Sponsor corrupt or impair the administration, security, fairness or proper play of the Contest and, if the Contest is modified, terminated or suspended, at Sponsor's discretion, select winners from those eligible, non-suspect entries. Winners further acknowledge that the Released Parties have neither made nor are in any manner responsible or liable for any warranty, representation or guarantee express or implied, in fact or in law, relative to the Contest or any prize, including, but not limited to, its quality or fitness for a particular purpose. 

Use of Data: Sponsor will collect personal data about entrants including e-mail addresses associated with entries in accordance with its Privacy Policy. Please review the Sponsor's Privacy Policy at the following link: https://www.members1st.org/privacy-policy. By participating in the Contest and providing your e-mail address, entrants hereby agree to Sponsor's collection and usage of their personal information and acknowledge that they have read and accepted Sponsor’s Privacy Policy.  Except where prohibited, you consent to Sponsor’s use of your name in any list of winners (if applicable) and for promotional purposes in any media without further payment or consideration.

Disputes: Except where prohibited, you agree that any and all disputes, claims and causes of action arising out of, or connected with, the Contest or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in the Commonwealth of Pennsylvania. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, your rights and obligations, or the rights and obligations of Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the laws of the Commonwealth of Pennsylvania, without giving effect to any choice of law or conflict of law rules (whether of the Commonwealth of Pennsylvania or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the  Commonwealth of Pennsylvania.

Winners List Request: To request the names of the winners, please send a self-addressed, stamped business size envelope, by May 28, 2025, to: Marketing and Communications Dept., 5000 Marketplace Way, Enola, PA 17025-2431. The title of the giveaway must be included in the request.
